Our Constitution is Still Needed

The Sixth Amendment

Continuing with the Bill of rights, I will now look at the 6th amendment to the Constitution.

Amendment VI

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.

Parts of this Amendment were also incorporated into the "Miranda Rights" that help to protect people arrested but not yet charged with a crime. It also guarantees our right to a speedy trial. Unfortunately, people who were involved in the Jan 6, 2021 protest in Washington D. C. are still being held without bail in prison in Washington with limited access to their lawyers and not allowed visits by their friends or family members. So much for equal justice under the law. Especially for those that disagree with the Democrats. These people have been in prison for over a year. the ones that have gone to trial have been charged with misdemeanors which would have meant they would have been sentenced to less time than they were waiting in prison for a trial.

Amendment VII

In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.

This is our guarantee of a trial by jury in any criminal case.

Amendment VIII

Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

Judges violating this amendment by setting bail at $1,000,000 or more for crimes committed by minority criminals are the reason why many cities have passed no bail laws for low-income high-risk criminals. It was also used to get rid of the death penalty in many states, it put an end to public flogging and hanging as well.

Amendment IX

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

This amendment was written to ensure that all rights enumerated in this Constitution are not violated because of some perverted interpretation of another article or amendment to it. That is the primary reason for writing these articles.

Amendment X

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

This amendment has been neglected by the Federal government more than any other. It is also the reason why so many in Washington do not uphold their oath to protect and defend the Constitution. Both Democrats and the 'Never Trump' both believe that everything should be controlled by Washington D.C. They pretty much disagree on everything else. But they both think that all of our rights come from them, not the Constitution. This is a very dangerous belief. That is also why I am writing these articles, so that 'We the People' can learn about our 'Founding Documents' and what kind of country our founders wanted us to have.

When I joined the Military, I took an oath to uphold and defend the Constitution against all enemies, foreign and domestic. I believe the enemies of it have taken over both parties. After the Constitution was drafted and ratified, one of the Founders, I believe it was Ben Franklin told the Nation "we must bind our Representatives, as if by chains, to it. How can we do this if we don't even know what it says.
