How to fix the LSAT...Part One

And why we shouldn't teach lawyers how to make irrational decisions...

In 2018 while preparing to take the LSAT I began realizing the problems with the LSAT.

1) It teaches law students to argue, not represent and make arguments out of the realm of legality. It doesn't teach or test your ability to anything other than think in a converse manner.

2) The subject matter like something happening on the Galapagos islands, has no bearing on what you need to be successful in law school. It's like testing a firefighter on the exchange rate of dollars to Euros and asking them to find the origin point of a fire using that conversion rate. Nothing to do with the price of tea in China.

3) The Logic Games section is better applied to real life issues I have used it to solve the everything from saving the football season during Covid to coming up with a solution to the bed crisis for Covid illness. Not anything that you would think to use it for but it has real world validity.

4) The LSAT should not be a scored test. Even nursing exams are pass/fail. Why are we holding would be law students with no formal training in law, to a higher standard than nurses after college. It is more an exclusionary test then a test of what should be desired in a law student. Law student's already come with a college degrees, so we are holding the bar so high that we are missing raw talent. Why are we excluding students based on a exam that the only thing that applies in law school is argumentation types.

I am not knocking LSAC. There has to be a central agency to handle the processing etc. My thought is simple..no opening statement, or judicial opinion was ever given 1 minute and 25 seconds to review a stimulus, establish what was going on, review a question stem and decipher 5 answers. Legal cases take months even years of investigation, hours of attorneys pouring over paperwork, and establishing a foundation for trial. How do you test that in 1 minute and 25 seconds and 35 minutes per section? You can't. Great legal minds don't even spend that drinking coffee to wake up in the morning, much less on a Saturday.

The biggest issue..commonsense.If you have any you are at a disadvantage. One of the biggest issues is the fact you MUST accept the stimulus to be true. Sorry but if you are telling me the sky is polka dot like my rain boots (in pink and black I might add), and I can look out any window at anytime in my or anyone else's life and tell you it is cloudy, sunny or some other variant, there is no way to convince yourself the sky ever was or could be polka dot no matter what premise supports it.

It's about like Jennifer Davenport, the Assistant Chatham County attorney arguing that under Ga law a public employee must prove why she shouldn't be fired- and yes she did. Sadly it appears the Ga Supreme Court didn't read a Petition for Writ of Certiorari that cited misconduct by her, her boss and her staff and whose decision I still haven't seen because someone stole all my mail in March 2019 that no post office in Savannah could find that included my federal financial aid to go to law school in Alabama, my Federal EIC refund check for over $300, all my bills, and that the Untied States postal service has been aware of since Dec 2019, but failed to investigate .

Jennifer Davenport's also famous arguments include aa long list of Appellate briefs from her time in the public defender's office that a 3 yr old with crayon and no vocabulary could have written to make more sense, the infamous nest issue on Tybee where she argued that contractors the County hired who had disturbed a federally protected nest where responsible despite having been hired by the county to do the work, it would have been the county that would have had to issue any permits and then their is her infamous argument that she can represent herself in case where she committed the misconduct alleged to the Ga Supreme Court along with her staff that were altering USPS mail by removing their signature, refusing to send documents she filed with the Ga Supreme court until weeks after after it had been filed and no less than 3 separate requests were made for . Then she would mail it to further prevent any response from being filed by cutting down on the deadline when she could email a false Writ of Injunction to have my firearm taken because I called thee FBI and Chatham County Sheriff John Wilcher because I was concerned about my safety.

These are the the real life consequences of teaching lawyers to cover up their inability to make a case with superfluous arguments. If I could write and argue to the Ga Supreme Court a Petition of Writ of Certiorari while studying for the LSAT, that was only dismissed because Chatham County law enforcement took all of the evidence and paperwork, while rewriting the LSAT, keeping up a home and being harassed by Chatham County law enforcement there is no indication that I was wrong. The only argument Jennifer Davenport made was that I had to prove why I shouldn't have been fired. That doesn't negate her misconduct, her bosses misconduct, the failure of Chatham County to abide by it's required due process, the failure of their to be the proper degrees of separation, or any illegality.

This a perfect example of failure to teach ethics, and only how to poorly construct a case that required her to breach every rule a lawyer should follow and law enforcement to assist her to win a case. Doesn't mean she is a good lawyer or that UGA did a great job teaching her anything.

If the LSAT was based on case law, even if modified as they do the stimuli in the LSAT would that not be a better predictor of reasoning and ability to use law and argumentation types. Would it not be better to weed out the Jennifer Davenport's of the world who don't care about anything other winning even if it means causing a women to be raped? I would be far more concerned about the effects of all her poor arguments on people and her ability to sleep at night while doing it merely because she thinks answering her bosses email is a great idea..So for all of the people that Jennifer Davenport has screwed from a firefighter's wife who died in the line of duty, to all the people she continues to skip Department of Labor hearings for to allow them to lie..Why don't we think about revising what we are testing for.. and including those that show so much potential and drive they can make a change in the world rather than creating lawyers who have no concern about damaging cases and people while they lie to judges.
