What To Do After Getting a DUI

What to do.

When you've been arrested for a DUI, the single best thing you can do is accept responsibility for your actions. You did something dangerous that you should not have done, and now you're facing the consequences. The quicker you learn to face the consequences, the quicker you can begin rebuilding your life so that you can get back to normal. Here are four steps to take after receiving a DUI.

Remember Everything

Unfortunately, due to the nature of the offense, you may not be in the proper state of mind to remember all the events leading up to your arrest. However, if you can find a way to commit exact details to memory, or better yet, write them down, even the smallest detail can help your case immensely. The most basic aspects to jot down about your situation are the who, what, when, where, and why. Who pulled you over? What did he or she do when he or she pulled you over? When did he or she pull you over? Where did he or she pull you over? Why did he or she have cause to pull you over?

Get a Lawyer

A good lawyer can be the best possible asset for a DUI case. The main job of an effective Phoenix DUI attorney will be to lessen your sentence if you plead guilty and drop the charges entirely if you plead innocent. Chances are, your lawyer won't be able to get you off with no punishment if you plead guilty, and you shouldn't expect that from him or her. Once again, this goes back to accepting responsibility for your actions. The best thing you can do to aid your lawyer is to be honest with him or her and have a gracious presence in court.

Have a Good Court Presence

Your sentencing will be largely dependent upon the image that you put on in the courtroom. If you plead guilty and can show the judge of your case that you are remorseful for your actions and you are taking steps to improve your behavior, he or she will be more likely to be lenient on your sentence. If you plead innocent and can show the judge that you can stay calm, cool, and collected while rationally explaining your side of the story, he or she will be more likely to let you go free. Beyond your demeanor, your physical presence is also important. The judge's first impression of you will be the first time he or she sees you, and if you are dressed professionally, it will show the judge that you are taking the situation seriously. Avoid casual and baggy clothing and instead opt for a blouse or button-down shirt and slacks.

Rebuild Afterwards

After your sentence is up, whether it's community service, a fine, or jail time, it's time to rebuild your life. Being charged with a DUI doesn't have to mean the end of a successful life. As long as you don't repeat the offense, there are ways to get back on your feet. You can begin by getting your license back. You will have to wait a minimum of 180 days before you can apply to have your license reinstated. The requirements to have your license reinstated can vary by state and county, but generally, you'll have to appeal to a court or visit a DMV and pay a fee or provide documents before you can be reinstated.

Whether you're truly guilty or not, staying calm, aware, and smart during the process of your DUI charge is vital. Your lawyer will be a great asset to you. Lawyers know the ins and outs of the legal system, and he or she will be able to tell you what actions will give you the best chance of a lenient or nonexistent sentence. However, remember that lawyers can't save you from everything, and you still need to take responsibility for your actions.
