EB-1to EB-5 is the mainstream because many of us don’t have a relationship with the United States. EB represents employment-based, which means the immigration category is based on employment relationships.

It is a plan for top talents, with the shortest schedule and the fastest green card in a few months. But the threshold for applicants is the highest.

The Grade system

It must be recognized by the international community. For example, winning the Nobel Prize, the Oscar Award, the Pulitzer Prize, and other internationally renowned top awards, but this level is very difficult.

These are immigrant visas that outstanding talents can apply for. Also, the artists or athletes who do not want to get a green card can apply for O-1 Visa. These visa holders need to provide performances in the United States for a period of time in the future or work plans arranged by American employers. For outstanding talents, if the EB-1 immigrant visa has not been approved, the O-1 can be used as a work visa to temporarily enter the United States.

EB-1C

It is an option for executives of multinational companies. It needs to invest and operate companies in the United States. The comprehensive investment is comparable to the investment immigration of 500,000 USD, but the speed is fast. It will be provided with the L-1 visa quickly land in the United States. The advantage of EB-1C is that if the first application is unsuccessful, no bad records will be left, and you can adjust the direction of business according to the reason for the refusal, and apply repeatedly within the validity period of the L-1.

NIW (National Interest Waiver) in EB-2

NIW and EB-1's outstanding talents are very similar, but the requirements are not so high. It is a plan that elites can choose. The schedule is determined according to the overall schedule of EB-2. In the practical stage, we sometimes associate outstanding talents with NIW at the same time. NIW belongs to the EB-2 employer-sponsored immigration sequence and has to comply with the EB-2 waiting time, which is about 3–5 years.

EB-2 & EB-3 (skilled Immigrants)

It needs an employer in the United States who is willing to hire you, through the employer to help us apply for a one-step green card in the United States. There are high requirements for the applicant’s background and the resources of American employers. It is suitable for middle-class people with certain financial strength can choose. The waiting period is about 3–5 years. After passing the immigration interview, the whole family can stay in the United States and obtain a green card, but it is necessary to work for the employer for at least 1 year.

EB-2 and EB-3 are also the last immigration road for skilled workers.

For skilled workers, you don’t need to invest much money in the United States. you don’t need to prove how much you have, and there are no language requirements. This method is the channel for the United States to absorb technical talents from around the world for a long time.

In addition to the above professionals, there are some skilled jobs that also belong to the EB3 technical category, such as restaurant chefs. The applicant must have at least 2 years of work experience, and have a chef certificate, and relevant asocial security records proving work experience are required.

EB-3 Unskilled Immigrants

This is suitable for ordinary people can choose, also known as unskilled employer-sponsored immigration. The threshold is low, and there are no requirements for applicants, only need a physical heath report and no criminal record. The age should not exceed 45 years old, and the child should preferably be no more than 8 years old. The only disadvantage of non-technical EB-3 is the long queue, which will take about 10–13 years, but the advantage is that cost is low.

EB-4

You may be eligible for an employment-based, fourth preference (EB-4) visa if you are a special immigrant. The following special immigrants are eligible for the fourth preference visa:

Religious workers;

Special Immigrant Juveniles;

Certain broadcasters;

Certain retired officers or employees of a G-4 international organization or NATO-6 civilian employees and their family members;

Certain employees of the U.S. government who are abroad and their family members;

Members of the U.S. armed forces;

Panama Canal Company or Canal Zone government employees;

Certain physicians licensed and practicing medicine in a U.S. state as of Jan. 9, 1978;

Afghan or Iraqi translators or interpreters;

Iraqis who were employed by or on behalf of the U.S. government; and

Afghans who were employed by the U.S. government or International Security Assistance Force (ISAF).

It is the investment immigrants need to invest USD500,000 in risky projects in the United States, because too many people have signed up in recent years, far exceeding the annual quota of EB-5. EB-5 has 2 ways, 1 is the direct investment model, which requires an investment of at least USD 1 million, another is a project involving a regional center that requires an investment of at least USD500,000. Both models have to create 10 jobs.
