Online Gambling Growth in India Shows Need for Progressive Law

The online gambling business in India is expanding. Its current value is $930 million, and according to predictions, it will be worth more than $112 billion by 2025. Many reasons are driving the growth of India's gaming sector. One of them is that India has one of the world's youngest populations.

According to the latest recent figures, there are over 560 Internet users in India. Furthermore, approximately 748 million Indians own mobile phones. All of these reasons, when combined, resulted in the exponential expansion of the country's real money online gaming sector.

Is Online Gambling Legal in India?

The legal landscape in India for gambling is very complex due to the country's 27 independent states. This implies that the legal status of the internet gambling business in the United States differs by state. The gaming business in India is governed at both the state and national levels. A new study on gambling regulation in India gives comprehensive information on the existing regulations that regulate the gaming sector.

If we had to examine the regulations on a national scale, we would highlight three major pieces of legislation: the Public Gambling Act of 1867, the Prize Competition Act of 1955, and the Information Technology Act of 2000. As you can see, they were all passed years ago, before the internet gaming business ever existed.

What the Laws Say

All kinds of gaming are prohibited by the Public Gambling Act of 1867. Some argue that this statute applies to both online and offline gaming. However, the Internet had not yet been developed when the Act went into effect.

The Prize Competition Act prohibits any type of prize competition with a prize pool of more than one thousand rupees each month. Despite the fact that the Information Technology Act of 2000 can be used for online gambling, it does not say that this kind of entertainment is prohibited.

Currently, India does not have appropriate laws in place to deal with the phenomenal expansion of the online gaming sector. Despite the fact that internet gambling is prohibited in the majority of Indian states, no one has ever been punished for using a web-based casino.

Sikkim is India's only state that has adopted explicit internet gaming rules. Casino lovers in Sikkim may now play a variety of table games online thanks to the Sikkim Online Gaming (Regulation) Act of 2008. When it comes to land-based casinos, only Sikkim and Goa have a small number of them.

Why Online Gambling Should Be Regulated in India?

As a result of India's confusing gambling rules, the country's economy suffers. The booming gambling industry has the potential to generate millions of dollars for Indian government coffers. Instead, the money is transmitted to offshore gambling sites that cater to Indian players. Furthermore, the government lacks the authority to protect players' interests and mediate disputes between players and casino owners.

India will reduce illegal gambling and enhance the economy by regulating the online gaming sector. Furthermore, the government will be able to properly assess the number of persons afflicted by gambling issues and assist them in dealing with the problem.

In general, India distinguishes between luck-based and skill-based games. Simply defined, skill games are those that rely on a player's understanding of the game. However, no game is totally dependent on chance or skill. There is no disputing that certain games rely more on skill or chance than others, but every game incorporates both. As a result, such a distinction is unjustified, and this is one of the reasons why India's gaming regulations should be revised.

The Future of the Online Gambling Industry in India

Many industry analysts believe that the Indian online gaming business will continue to thrive, and we wholeheartedly agree. The only issue is that certain Indian states refuse to let go of the past and embrace the future. Andhra Pradesh, for example, has issued an Ordinance stating that the state will never control the internet gaming sector.

On a more positive note, several other states are looking at the possibility of regulating the internet gambling sector. In our humble view, if a single state takes some moves toward regulating the business, many more will follow suit.
