Imprisonment accused of biting the ears of two young men and disfiguring one of them

The Court of Cassation upheld a ruling by the Amman Court of Appeal to place an accused person in temporary labor for 3 years as a result of biting off the ears of two young men, which led to cutting off part of the ear of one of them (the pinna) and wounding the ear of the other.

According to the details of the case, “during the presence of the two complainants, the defendant, the defendant, and others in the Jubaiha area in May of 2021, a dispute occurred between one of the complainants and the defendant, which developed into a quarrel, as a result of which the accused bit the ear of the first complainant, which caused him an injury, and when the second complainant tried to withdraw the accused He was surprised when he bit his ear and gnawed at it, which led to cutting off part of the ear pinna.”

By referring the two complainants to forensic medicine, it was revealed that part of the ear of the first complainant was missing, and a wound was inflicted on the ear of the second complainant. He was treated and his personal right was forfeited from the accused.

The court found that these acts constitute all the pillars and elements of the felony of causing permanent disability and misdemeanour, and decided to place him in temporary labor for a period of three years.

It also convicted a second defendant who participated in the quarrel and beat one of the complainants with misdemeanour, and decided to imprison him for a week.

The accused did not accept the verdict, so he appealed it before the Amman Court of Appeal, which decided to uphold the verdict with regard to the charges of causing disability and harm.

The accused did not accept the ruling, so he challenged it in cassation, and the Court of Cassation upheld the ruling and said that the actions of the accused, represented by biting the ear of the first complainant, which caused him to lose part of the earlobe, constitute, in legal application, all the pillars and elements of the felony of causing partial disability that has the appearance of permanent disability.

Incidents of ear biting during quarrels are frequent in Jordan from time to time. One of the most prominent of these incidents was when a former Jordanian deputy bit the ear of his colleague in 2001 after a quarrel that took place between them inside the parliament building reached fistfights and ended with one of them biting the ear of the other.
