RERA Tenancy Laws in Dubai

• Law No. (26) of 2007: This law regulates the relationship between landlords and tenants in Dubai.

• Law No. (33) of 2008: This law provided amendments regarding certain articles of Law No. (26) of 2007 and also moderates the landlord-tenant relationship in Dubai.

• Decree No. (26) of 2013: This law established the Rent Disputes Settlement Centre (RDSC), which handles all types of rental disputes in Dubai.

• Decree No. (43) of 2013: This law specifically governs rent increase in Dubai.

Terms of the RERA Tenancy Laws in Dubai

The following are the terms of the RERA Tenancy Laws in Dubai. Knowing about them will provide you a better renting experience in Dubai.

1. Perk for the Real Estate Regulatory Agency

According to the Law of Regulating Relationship between Landlords and Tenants in the Emirate of Dubai No. 26 of 2007, the real estate regulatory agency is subjected to follow some defined and particular contractual guidelines and boundaries that guarantee a smooth working of the Dubai’s rental property market.

2. Automatic Extension of Tenancy

Article 6 of RERA’s tenancy Law (26) of 2007 states that if the tenancy contract expires and the tenant continues to live in the property without objection from the landlord, the term of tenancy will be extended automatically for the same period or one year (whichever is less), on same terms and conditions. Furthermore, this law also provides a foundation of clear and transparent communication between the landlord and the tenant.

3. Registration through Ejari

4. Transfer of Property Ownership

In accordance with Article 28 of the property rent law in Dubai, a transfer of property ownership to a new owner will not impact the tenant’s right to occupy the property.

5. Amending the Terms of the Contract

In case of amending the terms of the contract, Article 14 of the Dubai tenancy law states to notify the other party at least ninety days prior to the contract’s expiry date. This is applicable to both, tenants and landlords. If alterations in clauses of rent amount, contract tenure or inclusion or exclusion of any other clauses occur, then the tenant or the landlord being subjected to shall be informed at least ninety days earlier.

6. Termination of a Tenancy Contract in Dubai

In terms of termination of a tenancy contract in Dubai, Article 7 of the RERA tenancy law in Dubai states that valid rental agreements cannot be terminated during its term, by the tenant or the landlord unless the both parties come under an agreement to do so.

Article 27 of RERA tenancy law states that tenancy agreement does not expires in case of the demise of the landlord or a tenant. IN such circumstances, the rightful heirs to the party are transferred the tenancy rights and the contract stands valid unless they wish to terminate it. If they choose to terminate the contract then a 30-day prior notice should be given to the landlord.
