What Are The Streams Under This Visa?

The Employer Sponsored Visa 186 has three streams under it, of which anyone you can apply for.

1. Temporary Residence Transition Stream

If you hold the 457 Visa and have worked for any Australian employer for 2 years (which excludes the unpaid leave period) in the same occupation you have been nominated to work permanently for the 186 Visa Australia, you can apply under this stream.

For this stream, you will not need to show any skills assessment outcome. But, like other streams, the English level requirement is a must unless exempted. If you appear in the IELTS test, you should get at least a 5 band score in each module. Any secondary applicant aged over 18 needs to have a Functional level of English.

2. Direct Entry Stream

Aren’t you a 457 visa holder? Don’t worry. Still, you can apply for the 186 Visa Australia. In that case, you have to choose the Direct Entry Stream and must have worked in the specific nominated occupation for at least 3 years.

Unlike the Temporary Residence Stream, you have to undertake a skills assessment for this stream. The English language requirement is also higher compared to that for the previously discussed stream. If you appear for the IELTS, a band score of 6 in each module will be required.

3. Agreement Stream

If an Australian employer sponsors you through a labour agreement, you can apply for this stream.

Right now, there are only two lists - MLTSSL (Medium and Long-term Strategic Skills) and STSOL (Short-Term Skilled Occupation List), and the employer has to nominate an employee for an occupation that is present on any one of these lists.

What Are The Eligibility Criteria For The Application?

Both the applicant and the employer needs to meet specific Visa Subclass 186 requirements. Let us first discuss the eligibility criteria for the applicants, which are as follows.

  • The maximum age limit is 45 years at the time of application.
  • You must get the nomination from an Australian company that is currently operational in Australia.
  • You must meet the skill and qualification requirements for the specific job position.
  • You have to provide the required English language proficiency test results unless exempted.
  • You have to meet proper character health and character requirements. Health requirements include results of prescribed medical examinations. For character requirements, you have to submit the police clearance certificates.
  • You should also meet the stream-specific criteria. For example, you should have a minimum of 3 years of work experience.

  • The business must be legal as per Australian law and currently active.
  • They have to meet the training benchmark requirements (1% or 2%).
  • The employer must prove that they genuinely need a full-time employee for a minimum of 2 years.

  • The employer should get the payment according to the industry standards.
