What are the steps to follow to start a business?

The main steps necessary for the creation of an online company are five in number, namely:

  • Carrying out a market study;
  • Building a business plan;
  • The choice of legal status;
  • The choice of registered office;
  • Completion of company registration formalities.

Step 1: Conduct market research

The first step is to carry out a market study. The latter makes it possible to define the profitability of the idea at the origin of the business creation.

To carry out this study, it is necessary to define the following elements:

  • The offer: corresponding to the product or service offered by the company
  • Demand: i.e. the customers to whom the products or services offered are addressed
  • The environment: which consists of all the external parameters likely to influence supply and demand
  • Commercial strategy: corresponding to the way of selling the product or service
  • The construction of the provisional budget

The entrepreneur can carry out his market research alone. It may also call on external service providers.

Step 2: Build a business plan

The construction of the business plan is a very important step when creating a company such as the creation of a service company . Its objective is to present the business creation project. The latter is therefore an essential tool for convincing banks and investors when looking for financing .

The business plan consists of a written file composed of five parts:

  • The introduction or presentation pitch
  • The presentation of the product/service offered by the company
  • Presentation of the business model/commercial strategy
  • Market research
  • The financial forecast

In addition to the business plan, it is also possible to carry out a PESTEL analysis , with the aim of studying the company's environment, its future prospects as well as its strengths and weaknesses.

Step 3: Choosing the legal status

When setting up a business, the entrepreneur must also choose the legal form of his future business, taking into account the following parameters :

  • The number of partners
  • The amount of contributions
  • The taxation of profits
  • The social and tax system for partners

Step 4: Domiciling your business

When creating his business, the entrepreneur must also take care to choose premises adapted to the needs of his future professional activity.

  • If the activity carried out does not require the use of premises, the company may be domiciled at the personal address of the entrepreneur or via the services of a domiciliation company.
  • If it requires the use of a room, in this case it will then be necessary to carry out research to find a room in accordance with the activity carried out.

Step 5: Complete the company registration formalities

Once the previous steps have been completed, the entrepreneur must carry out all the administrative formalities to register the company, namely:

  • The drafting of the statutes;
  • The deposit of share capital;
  • The publication of a notice of incorporation in the JAL;
  • The filing of the registration application file on the INPI website.

Drafting of statutes

It is essential to write your articles of association well when setting up a business. Indeed, it is the latter who come to determine the rules of operation of the company as well as the distribution of powers between managers and partners. As a result, they must include a certain number of mandatory information , in particular:

  • The corporate name
  • Head office address
  • The corporate purpose
  • The distribution of shares or shares between the partners
  • The nature and amount of contributions to the share capital
  • The management and management bodies of the company

The statutes can be drawn up by the entrepreneur himself. However, the latter can also call on an online service provider or a legal professional (lawyer or notary). He can thus benefit from a certain legal certainty and avoid having to modify them during his social life, saving him additional costs.
