Stop Violating the Constitutional Rights of Parents

Introduction:

The rights of a child’s BIOLOGICAL parents are in fact PROTECTED under the 14th amendment of the U.S. Constitution. I will provide a link in the sources at the end of this article so that you can read the 14th amendment in detail if you would like, but for now I will just explain in simple terms a few of the things that the United States Constitution says regarding the Constitutional rights of a parent. (The specific parts of the 14th amendment that I am going to list in this particular article are A FEW of the MANY that seem to be frequently violated by Family Court, CPS, and/or State/Government agencies/officials. I will also give examples of how some of these rights have been violated.)

FREQUENT Violations of Constitutional Parental Rights:

#1: Parents have the right to direct the upbringing, education, and care of their children WITHOUT interference from State/Government as long as they are meeting their children's needs and are not abusing, neglecting, or putting them at risk. (Example: Parents can decide what type of schooling their children receive-home school, public school, religious school, private school, etc.) 1.A: Example of a violation of this parental right: When child protective services take your child and refuses to return them without you completing parenting classes. This is a DIRECT violation because of the fact that these classes are based on the State’s standard of parenting. If parents have the right to direct the upbringing of their children without government and state interference (with the exception of cases involving abuse, neglect, risk of danger, etc.), then the State has no true right to even make or enforce parenting standards to begin with, much less force and coerce a parent to abide by them with threats against their parental rights. If neither abuse nor neglect can be proven, then forcing a State’s parental standard of ANY KIND on a parent is unacceptable at best.

#2: Right to Due Process: This is a right that every American citizen is entitled to, INCLUDING parents. Due Process is a LEGAL REQUIREMNET of rules and principles used when resolving legal matters FAIRLY. This applies to BOTH Civil AND Criminal cases. 2.A: How is this right being violated? Simple. Removing a child from their parents without a court order, then getting a court order 24–48 hours later and making the parents show up to court is NOT due process. (Parents are also often having their rights terminated due to FALSE allegations, LIES told by CPS workers UNDER OATH, as well as parents being DENIED the right to speak, or defend themselves in any way shape or form in court. So, basically, often times parents have to sit there and listen to CPS intentionally LIE and are denied the ability to give their side of the story, present evidence to the judge, or do anything else to defend themselves. Parents are often told that their court appointed attorney can speak on their behalf, but because this attorney is often times lazy or paid by the same people as CPS, they deliberately fail to represent parents properly.) Does any of that sound fair to you? No? That’s because it isn’t, and so therefore, it IS NOT DUE PROCESS.

Additional FREQUENT Violations of Parents and Familes:

1.) In order for child protective services to have a court terminate a parent’s rights to their child and/or children, they need to be able to PROVE that the parents are in some way or another UNFIT to properly care for their child and/or children, so, how is it that often times, CPS is not even required to present evidence that there is a legitimate reason to permanently separate a child from their parents? How is it that CPS is allowed to LIE UNDER OATH in order to keep children from their parents? (If there was a legitimate reason to separate the family, then lying would be unnecessary in the first place, so basically, all CPS needs is an allegation, and to testify that they believe the allegation, and that’s considered enough of a cause to permanently separate a family.)

2.) In the event that it is determined that a child needs to be removed from the home during the investigation, child protective services is REQUIRED to attempt to place the child and/or children who are being removed with a FAMILY MEMBER. Foster care is supposed to be a LAST RESORT (as is the removal of a child), as it is traumatic to the children as well as the parents and the family as a whole. This is yet another example of CPS violating rights, laws, policies, etc., as children are FEQUENTLY removed from their parents (without a court order or legitimate reasoning), and then placed in Foster Care either without the attempt by CPS to find a suitable relative for placement, or by CPS simply saying that they made an attempt for family placement and could not find one, when in reality they went directly to Foster Care placement without giving any family members the chance they are entitled to.

Conclusion:

Removing a child from his or her biological parents and family is traumatic whether it is needed or not, so imagine the trauma on the children, parents, and families involved when the removal is completely unnecessary. If there is another option, then those options should be perused to the full extent before inflicting this type of damage on the lives of a family. If a CPS worker is not willing to do anything in his or her power to prevent this type of lifelong damage and trauma from occurring to a child, but would rather DELIBERATELY and INTENTIONALLY cause it by removing children WRONGFULLY and lying to keep them separated from their parents, then are they really protecting the child? It’s certainly not in the best interest for ANY CHILD to be needlessly separated from their biological parents and family, and that has been PROVEN and backed by PROFESSIONALS with YEARS of experience in fields concerning mental health, children's needs, etc., so with that being said, it should take a lot more than a false allegation and the PERSONAL OPINION (not a professional opinion, not an opinion backed by any fact or evidence) to determine whether or not a child needs to be separated from their families. These are children’s lives. These are parent’s lives. Why is it okay for them to be gambled with, and forcibly destroyed and damaged with absolutely no cause? If money is the only reason that this kind of unfair, immoral, unethical, and inhumane ignorance is being considered acceptable, then something needs to change. In what world is money an acceptable reason to permanently traumatize innocent children?

No matter how many lies are told to cover up the act of removing children from their families without due process for the purpose of profit, the facts are out there. It’s been proven, multiple times, in multiple places, by multiple families. There is no real way to deny it, and even if there was, the trust is broken. People do not trust these agencies anymore because the bad outweighs and out shadows even the slightest glimmer of the good. So, how many more families need to be destroyed before something gets done? How many good parents are going to be denied their parental rights over false allegations, petty lies, and personal judgements? This complete lack of morals, ethics, and accountability, combined with the violation of rights and denial of Due Process is the DIRECT cause for the overflowing Foster Care System, and IT IS NOT JUSTICE. Not for the children, not for the parents, and not for the families. The time for change is now.
