Judge Jon Tigar of the California Northern District Court had previously ruled against a similar policy under the Trump administration. During a recent court hearing, he expressed skepticism about any significant differences between Biden's policy and the Trump-era one, despite the administration's insistence otherwise.

The lawsuit that prompted this ruling was brought forth by the American Civil Liberties Union (ACLU) and other immigrant rights groups. The legal battle centers around a new asylum rule that largely bars migrants who passed through another country from seeking asylum in the United States, marking a significant departure from longstanding protocols.

The Biden administration, facing pressure to manage the surge in migration, has been hit with multiple lawsuits from Republican states and advocates alike. Tigar's ruling adds further uncertainty to Biden's border plans.

Although the policy was introduced as a means of controlling migration, it has faced heavy criticism from Biden's allies, Democratic lawmakers, and immigrant advocates. The ACLU hailed the court's decision as a victory, but also expressed concern about the prolonged fight over the policy, which continues to put vulnerable individuals in harm's way.
