Confused by Election Lawsuits

A quick primer on Nov. 3 legal actions across USA

There is a patchwork of stories regarding the various election lawsuits in the six swing states cited with irregularities in the 2020 Presidential election. While it is enough to make anyone's head spin, the various legal actions can be broken down by state. Several lawsuits related to the 2020 elections were filed in several if not all the swing states in question. Here is a list of those filed in multiple states.

Texas vs. Georgia, Pennsylvania, Michigan, Wisconsin -

This was filed and docketed at the United State Supreme Court. Defendant states had until 3 p.m. Thursday to file a response to the motion for emergency relief in the complaint.

Eighteen states have filed a friend of the court brief and six, Missouri, Arkansas, Louisiana, Mississippi, South Carolina and Utah, have joined in the lawsuit. President Donald Trump has also joined in the lawsuit. There is a move among California voters urging the state to join the lawsuit.

The basis of the lawsuit is that Texas followed constitutional provisions of hosting its election while the four states in question did not, therefore diluting the legal votes of citizens in Texas. At question were election law changes made by the Secretary of State Offices in those defendant states because of the coronavirus pandemic when only the state legislatures can legally change voting laws.

Sidney Powell's Kraken Lawsuits

Attorney Sidney Powell filed a lawsuits in Georgia, Michigan, Arizona, Wisconsin alleging outright election fraud in Georgia with documents alleging an algorithm weighted votes for Biden to a greater degree than those voting for Trump, among other allegations.

A portion of her lawsuits were to ask the court to order forensic audits of Dominion voting machines so she may add further evidence to her case. Her Georgia lawsuit was dismissed by a federal judge in Atlanta while her Michigan suit faced a similar fate the same day. Judges in Arizona and Wisconsin handed Powell similar results on Wednesday. Powell said she is appealing all her cases.

Thomas More Society Amistad Lawsuits

The Chicago non-profit filed lawsuits in Wisconsin, Pennsylvania, Michigan, Nevada Georgia and Arizona. The group alleges a number of entities from government officials to private groups orchestrated the 2020 election fraud to benefit candidate Joe Biden.

Currently the focus of the lawsuit is in Wisconsin where it is winding its way through the courts.

Besides the multi-state filings, citizens and local groups have also launched lawsuits in all of the swing states. Below is a list of those.

Arizona

Republican Electors vs. State of Arizona

Eleven would be GOP electors, headed in the lawsuit by Arizona GOP Chair Kelli Ward, filed a suit over alleged irregularities and elements of fraud in the Arizona election. It was dismissed Wednesday by U.S. District Judge Diane Humetewa, who said their claims were baseless. The plaintiffs sought relief by seeking decertification of the election, declare there was ballot fraud and demand a manual recount of early votes with the challengers allowed to seize and inspect voting hardware, software and camera recordings. No word yet if they will appeal.

Nevada

Trump Campaign Lawsuit

The plaintiffs in this case were Nevada electors for Trump and the heart of it was alleged problems with the electronic signature matching program and widespread voter fraud. The campaign alleged the matching program allowed compatibility as low as 40 percent. Voter fraud allegations included votes cast more than once and votes cast by deceased voters.

The case was appealed to the Nevada Supreme Court after a district court struck it down, citing there was no credible or reliable evidence of fraud. The Nevada Supreme Court also struck the case down with a 6-0 ruling late Tuesday. The case can be appealed to the U.S. Supreme Court.

Georgia

Lin Wood's WeThePeople lawsuit

Attorney Lin Wood, who defended security guard Richard Jewell in the Centennial Park bombing case and later as Jewell sued for defamation, filed a lawsuit as a citizen alleging his vote was diminished by all the voting irregularities in Georgia. A federal judge, Judge Batton of Atlanta, who also dismissed Powell's Georgia case, dismissed the lawsuit based on lack of standing. Wood has since appealed.

Georgia Republican Party vs. State of Georgia

The state's GOP party launched a lawsuit Monday in the state over "low tech" fraud, which includes fraudulent votes, dead people voting, felons voting and other similar types of conduct. The case has yet to be heard in court.

Ken Auman U.S. Supreme Court Writ

Auman is a resident who filed a writ to the Supreme Court arguing that Georgia is in danger of losing its statehood for failing to follow constitutional requirements of being a state, which includes holding constitutionally valid elections. The writ could be docketed for court review within the next week.

Michigan

Antrim County Lawsuit

A hearing was held Thursday, Dec. 10 where the county judge allowed the Secretary of State Jocelyn Benson to enter the case. The plaintiffs are filing two new motions based on their evidence that press releases sent from the Secretary of State's office were completely false. The plaintiff's attorney said the "glitch" caught election night that switched votes from Trump to Biden has been proved to not be a glitch but was a deliberate fraud attempt.

The lawsuit seeks to decertify Michigan's electoral votes because the number of irregularities make results "uncertifiable."

The case centers around a Central Lake Township resident William Bailey, represented by attorney Matthew DePerno, alleging in a lawsuit that three non-counted ballots allowed for approval of a marijuana dispensary in the township. Because of that case, a 13th Circuit Court Judge ordered a forensic audit of 22 Dominion tabulators and related software.

The audit was done Sunday by the cybersecurity firm Allied Security Operations Group. The firm has testified on behalf of the Trump campaign and others in election lawsuits.

Black Voices for Trump, Angelic Johnson and Linda L. Tarver vs. State of Michigan

Republican voters joined with Black Voices in filing a request for an expedited hearing before the Michigan Supreme Court in November. The court ruled 4-3 against taking up the case with the majority stating the court didn't have the power to order an audit, seize ballots or decertifying the state's election. The lawsuit, like others, makes claims of voter fraud but centers on 355,392 "unsolicited ballots" the plaintiffs state are improper because they are absentee ballots. The case can be appealed. No word yet on whether it will be appealed.

Pennsylvania

Rep. Mike Kelly vs. State of Pennsylvania

This lawsuit throws into question changes made in 2019 in the state that created an universal mail-in voting system where there voters did not have to give a reason for absentee voting. Kelly's suit claimed such measures were unconstitutional. He sought an emergency injunction to invalidate 2.5 million mail-in ballots counted in the Nov. 3 election.

While the media has present the narrative that Justice Samuel Ailto dismissed the case, the actual truth is the justice, who is acting as a gatekeeper for the court in the case, denied the application for injunctive relief on Tuesday. The case itself remains alive in the U.S. Supreme Court but is pushed back for the Court to consider the Texas lawsuit first. Both cases address similar issues in Pennsylvania and the Texas case could remedy the problems presented in Kelly's case.
