A Handy Guide for NRIs

By NRI Legal ServicesPublished 2 years ago 4 min read

What is a NRE account?

An NRE (Non-Resident External) account is a specialized banking facility designed for Non-Resident Indians (NRIs) to deposit their foreign earnings in India. NRE account allows seamless fund transfers from abroad, provides tax benefits, and offers competitive interest rates to account holders. The primary advantage of an NRE account is that both the principal and the interest earned are fully repatriable and exempt from Indian income tax. This article will highlight step-by-step process for NRIs to open an NRE account and the tax benefits for NRIs.

Types of NRE account

There are several types of NRE accounts i.e., savings accounts, a fixed deposit account, a recurring deposit account, or a current account. An NRI can use this account to conduct transactions in India and seamlessly repatriate funds to their home country. They can open this account individually or jointly with another NRI.

Benefits of holding a NRE account

a) Liquidity

An NRE account allows easy transfer of funds from India to other countries without currency conversion hassles. The funds in this account can be quickly repatriated to their country of residence without any trouble.

b) Tax-free

In India, the funds deposited in the NRE account, i.e. the principal and the interest earn on it, are exempt from taxes.

c) Maintenance

An NRI can give power of attorney to an Indian resident who can operate their NRE account on his behalf from India. Except for the opening and closing of his NRE account, such an individual is permitted to take any actions required to operate the account smoothly, including withdrawing funds.

d) Multiple Transactions

An NRI can use the funds in this account to make multiple types of transactions that may be personal, business-related, or investment-related.

e) Withdrawal

An NRI can easily withdraw funds from the NRE account through an international debit card.

How to open a NRE account?

An NRI can open an NRE account at any authorized dealer bank. Banks offer an online account opening feature that does not require NRI to visit the bank’s branch in India. If the NRI meets the eligibility criteria for holding an NRE account, they can submit the following to open his NRE account.

Steps to open a NRE account

1. Select a Bank

The first step in opening an NRE account is selecting a bank that offers this service. Several reputed banks in India provide NRE account facilities, including:

  • State Bank of India (SBI)
  • HDFC Bank
  • ICICI Bank
  • Axis Bank
  • Kotak Mahindra Bank

It is advisable to compare the services, interest rates, and charges of different banks before finalizing one.

2. Check Eligibility

To open an NRE account, you must meet the following eligibility criteria:

  • The person should be an NRI (Non-resident Indian), a PIO (Person of Indian Origin), or an OCI (Overseas Citizen of India).
  • The person must deposit his earnings in a foreign currency
  • The person is a spouse of an Indian citizen or a PIO.
  • Power of attorney must be an Indian resident.

3. Gather Required Documents

Before proceeding with the application, ensure that you have all the necessary documents. These typically include:

  • Passport
  • Proof of NRI Status
  • Overseas residence proofs like driving license, utility bill, or overseas bank statement.
  • PAN Card – If unavailable, you can submit Form 60.
  • Recent Passport-size Photographs – typically, two to three copies are required.

All documents should be self-attested, and in some cases, they may require notarization or attestation by a competent authority.

4. Fill Out the NRE Account Application

Once you have the required documents, you need to fill out the application form for an NRE account.

  • The form can be downloaded from the bank’s official website or collected from a branch.
  • Fill in the details accurately, including personal information, overseas contact details, and nominee details if applicable.
  • Attach the required documents along with the application form.

5. Get Documents Attested (if required)

Some banks require additional verification and may ask for documents to be attested by:

  • The Indian Embassy
  • A Notary Public
  • A Banker in your residing country

This step confirms the genuineness of the submitted documents and prevents deception.

6. Submit the Application

Once the application form is completed along with required documents then submit the same in the bank:

  • If the person is residing outside India, then directly send the documents through courier to the bank’s NRI service branch.
  • If the person resides in India, then visit the nearest branch to submit the application along with the documents.

After submission, the bank will process your application. You may receive an account activation confirmation via email or post within a few days.

Tax implications of having a NRE account

The funds deposited in an NRE account are essentially their earnings in a foreign currency in India. The principal amount and the interest earned are free from tax. One is free to repatriate the principal and the interest amount without any restrictions. Repatriation means the transferability of your funds to a foreign account from an NRE account.

Conclusion

An NRE account is a convenient way to save earnings from a foreign country in India, especially when NRIs have transactions in India. And the type of NRE account they choose to open, as an NRI, should be based on their liquidity needs. It means that they must opt for an NRE term deposit account that will yield higher interest if they do not have liquidity requirements shortly. On the other hand, if they may have regular withdrawals, it is better to opt for an NRE savings account with moderate interest earnings.
