What is FSSAI?

FSSAI represents the Food Safety and Standards Authority of India which is the body that oversees and regulates the food business in India. It is an independent body established under the auspices of the Department of Health and Family Welfare, the Government of India.

FSSAI was established under the Food Safety and Standards Act, 2006 (FSS Act) which is an integrated system relating to food safety and regulation in India. It ensures that food products are tested for quality and thus reduces food production and sales of substandard products. It is responsible for registering and licensing Food Business Operators (FBOs) in India and sets the rules and regulations for conducting food business in India.

2. Why an FSSAI Registration Needed?

Everyone who works in the food business who participates in the manufacture, use, distribution or sale of food products must obtain an FSSAI Registration or license.

FSSAI registration is different from an FSSAI license in the sense that depending on the size and type of business, the FBO must obtain the required registration or license.

This registration process aims to create additional obligations to FBOs to maintain the quality of food products. The process and requirements for licensing and registration are governed by the Food Safety & Standards (Licensing and Registration of Food Business) Regulations, 2011.

3. FSSAI Registration / Licensing Process

FSSAI registration or license is based on business capacity and properties. Depending on the amount applied or the profit or location, the applicant's properties are eligible for a license such as a basic license, intermediate license, and state license.

4. Registration Requirements for FSSAI

FSSAI registration is a basic license and required for all FBOs involved in the small food business. This category includes the following businesses:

Any FBO with an annual profit of no more than Rs. 12 lakh.

A small retailer working with food products

Any person who makes or sells any food item alone

Food sales are done by a temporary store owner

Any person delivering food to any religious or recreational gathering other than the one eating food

5. Process for obtaining FSSAI Registration

The registration of FSSAI begins with the submission of Form A (application) to the Department of Food and Safety.

The application may be approved or rejected by the Department within 7 days from the date of receipt of the request and the refusal must be notified to the requester in writing.

If the application is approved, the department will issue a registration certificate with the registration number and photograph of the applicant.

The FBO must clearly display the registration certificate in the place of business during working hours.

The standard documents required for Basic, State, and Central Registration are passport photographs and proof of photo ID.

For State and Central licenses, the following additional documents will be required:

A completed Form B was signed

Proof of address

List of food category and products

The proposed site layout plan

List of resources

NOC from the municipality

Installation certificate

List of directors/partners

MOA and AOA

Water Test Report

6. FSSAI License Requirement

For all other FBOs except small businesses, an FSSAI license must be obtained. The FSSAI license can be divided into two categories namely State FSSAI License and FSSAI Central License according to the size of the business whether it is a medium or large business.

Typically, FBOs who are major producers, importers, exporters working in the big food business need to obtain FSSAI registration from the central government and FBO through small production units, transporter, retailers, retailers, etc. Registration of FSSAI from the national government. To apply for a State license FBO must have a profit between Rs 12 lakh to Rs 20 crore.

Other conditions include production units with a capacity of 2MT per day, commercial milk units of up to 5000 liters per day. 3 or more star hotels, repeaters, recoupment units, clubs, food coupons for all cooking businesses regardless of the profits they make an application for a license. The period of validity of the license may not exceed 5 years and a minimum of one year.

To apply for a medium license FBO must be profitable in excess of Rs. 20 crores and need to be operated in two or more regions. All exporters and exporters are required to apply for this license. Maximum 5 years and a minimum of one year.

9. Benefits of Obtaining an FSSAI Food License

Obtaining a license can give the food business legal benefits, build interest, ensure food security, create consumer awareness, and help expand the business. Also, it helps control, produce, store, distribute, and export food.

10. Consequences of Non-Compliance

Any person registered or licensed under the FSSAI must comply with the rules and regulations under the FSS Act, 2006. The food safety officer usually conducts inspections of the food business provider's facility and identifies compliance standards using a checklist. In terms of compliance, the food safety officer labels as:

Based on the above, the food safety officer may issue a notice of improvement where required in terms of section 32 of the FSS Act, 2006. If the businessman fails to comply with the notice of improvement after the official has given the licensee the opportunity to disclose the reason he or she may cancel his or her license. Any food processor who has been affected by notice of improvement may refer it to the National Food Security Commission. A decision on that matter may be challenged on appeal by the Food Safety Appellate Tribunal / High Court.

12. Renewal of FSSAI license

The FSSAI license is important to start a food business, similarly, it is important to renew the license. The license is valid for one or five years, so the entity must apply for renewal 30 days before the current license expires. FSSAI has introduced an online system called the Food Licensing and Registration System (FLRS) so that businesses can apply online for licenses.

FLRS is used in five Regional Offices to issue licenses and powers. Of course:
