How the State of Streaming Can Affect Streamers & Content Creators

On Friday of January 7th of 2022, Imane Anys, also known as Pokimane, was temporarily banned from Twitch after she was streaming Nickelodeon’s acclaimed series Avatar: The Last Airbender. This has stirred a discussion about what streamers should stream and what they shouldn’t stream. Many think it’s fine as long as they give a unique way to present for fair use. Others believe it’s a lazy way to get viewers with little to no effort. This also accounted for other creators also committing the same actions as Pokimane, but have not been called out for. So, let’s see how this incident can affect content creators and streamers.

To have such a thing allowed in Twitch and other streaming platforms may help the streamer gain large audiences. It shows that the streamer has similar interests in media to the fans. Or they can introduce a new series or film to a fan who hasn’t seen it. Although it’s done to gain viewers and fans, it is a lazy and unimaginative way to do so. This can lead to a stale steaming if the streamer constantly continues to view the same show or film. In addition, several copyright content are illegally being shown in its entirety. To reiterate what happened to Pokimane, she was temporarily banned from Twitch after watching Avatar: The Last Airbender. The series is owned by Nickelodeon, which is also part of the Viacom company. The company has been notorious for many lawsuits and copyright claims against content creators and streamers using their intellectual properties in any circumstance. With that notation, this can lead many other companies to do the same, even if their IP’s are used under fair use. Leading these companies to not prevent many from making references, criticisms, etc.

To bring a valid use of TV Meta, many streamers can view other content creators videos or projects. This can give small content creators or artists a way to get attention and exposure. Their works don’t rely on copyright laws, if they made their project with the sole purpose of making art. Another way TV Meta can be used, with intellectual property included, if a streamer applies fair use. To define fair use, it’s the doctrine that brief excerpts of copyright material may, under certain circumstances, be quoted verbatim for purposes such as criticism, news reporting, teaching, and research, without any permission to the copyright holder. To address how fair use works, streamers can use small clips in small doses of the intellectual property to avoid any trouble. Which doesn’t mean to stream the whole film or television series. If they got any criticism or have positive praise, they can express it with a small usage of the property. As such, TV Meta can be used to introduce people to original works that have artistic values, or to present a critique of an intellectual property that shares many or a few audience opinions.

So to bring the question: how will TV Meta affect the state of streaming to both streamers & content creators? If many continue to carelessly stream TV series and films in their entirety, it can create a large problem. This regards how copyright laws can prevent many to apply fair use, and to use intellectual property for one’s need to share their interest, or to critique the property. This can also lead large corporations to strict what people can say about their intellectual property, which strips away one’s freedom of speech. It would be an unbalanced way these companies can take advantage of smaller streamers of their livelihood. In conclusion, if streamers can’t find a way to use TV Meta with fair use and without causing piracy, this will cause a negative impact.
