The lawsuit accuses them of investing a significant amount of time and effort into searching for, hacking into, tampering with, manipulating, copying, disseminating, and generally fixating on data that they received, which was either taken or stolen. Giuliani has attempted to portray Hunter Biden as a corrupt businessman who profited from his father's political influence. Both Giuliani and Costello claim that they obtained the hard drive in 2020 from a computer repair shop owner in Delaware. An independent analysis conducted by two cyber investigators from Computer Forensics Services in Minneapolis found no indications of modification, fabrication, or tampering with the user data. However, reports from various media outlets, including The Washington Post, suggested that certain versions of the hard drive may have been tampered with as they contained data added after April 2019. The filing of this lawsuit represents the latest effort by Hunter Biden's legal team to forcefully counter the allegations made by his Republican adversaries, spanning several months. In February, Hunter Biden's attorney, Abbe Lowell, sent letters to 14 prominent Republican media personalities and former officials who had accused Hunter Biden of corruption or disseminated material purportedly sourced from the laptop. Lowell's letter explicitly outlined the need for these individuals to preserve and retain any records relating to Hunter Biden, as a litigation hold was in effect. obtained the laptop.

This indictment followed the collapse of a plea agreement in July between the government and Hunter Biden's legal team regarding his taxes and a diversion agreement concerning a firearms charge. Both Giuliani and Hunter Biden have pleaded not guilty in their respective cases, vehemently denying any misconduct. Giuliani and Costello, who had been close friends for almost 50 years, experienced a sudden rupture in their bond when Costello filed a lawsuit against Giuliani on September 19. In the lawsuit, Costello claims that Giuliani owes his law firm nearly $1.4 million in outstanding legal fees.
