Ruling on the application of Christian law for the second time in the history of Egypt

The ruling was issued by resorting to the Coptic Orthodox Regulation issued in 1938, which provides for the distribution of the estate equally between male and female heirs.

Judgment was issued in Appeal No. 21635 of 131 judicial year, filed by the daughter of the deceased citizen, “Azmi.A.A.”, on the ruling of the first instance rejecting the invalidity of inheritance notification No. 1354 of 2020 Al-Zawiya Al-Hamra, which was adjudicated regarding the distribution of her father’s estate to The provisions of Islamic law.

The judicial dispute that ended with the issuance of that ruling began with a lawsuit filed by the plaintiff before the Al-Zawiya Al-Hamra Family Court in Cairo, in which she said that the heirs of her deceased father are all Orthodox Copts and that the provisions of Christian law are applicable in the matter of mediating inheritance, despite the appearance of her two male brothers before However, the Court of First Instance ruled in the session of last July 31 to reject the claim for the invalidity of the inheritance notification, and to keep it governed by Islamic law.

Accordingly, the plaintiff filed an appeal against the verdict, in which she asserted that the verdict was issued by mistake in applying the law, given that the principles of Christian law are the first to be applied in this case.

The Court of Appeal for Family Affairs upheld the defenses of the appeals newspaper, stressing that Article 3 of the Egyptian Constitution 2014 stipulates that the principles of the laws of Egyptian Christians and Jews are the main source of legislation regulating their personal status, religious affairs, and choosing their spiritual leaders. ‏

The court also added that Article 245 of the Personal Status Regulations for Orthodox Copts issued in 1983 and amended in 2008 stipulated that the descendants of the inheritor take precedence over other relatives in the inheritance, so they take all the estate or what remains in it after fulfilling the share of the husband or wife. There were many branches of one degree, and the estate was divided among them in equal shares, with no difference in that between males and females.

The court added that according to that article, if the inheritor left two sons, each of them took half, and if he left three sons of the second degree, such as the son of a son or a daughter, and a son of a daughter, each of them took a third.

The court indicated that since the plaintiff had appeared and demanded the application of the principles of Christian law in inheritance in accordance with the provisions of Article Three of the current constitution and the articles of the aforementioned regulations, and it was proven from reviewing the case papers and documents that the court reassured that the notification of inheritance achieved the death of her father’s heirs. On August 30, 2020, however, the Court of First Instance violated the law and what was established in the papers and ruled to dismiss the case, and then its ruling was correct and did not coincide with the correct reality and law, and then it becomes clear that the plaintiff’s request came in accordance with the correct law that must be answered in it, and ordered the issuance of an inheritance notification new before the competent court that includes an application of Christian law.

It is worth noting that this ruling is not the first of its kind, as the Cairo Court of Appeal previously issued in 2016 the first judicial ruling in Appeal No. 11666 of 133 BC on November 20, 2016 from the 158th Circuit of Personal Status, applying the principles of Christian law represented in The list of Coptic Orthodox Christians in matters of inheritance stipulates equality in inheritance shares between males and females.

Before the issuance of that ruling, the provisions of inheritance contained in the Islamic Sharia were the ones that applied to everyone, whether they were Muslims or non-Muslims, despite the fact that the inheritance law issued in 1943 had added to it a special provision for the inheritance of non-Muslims according to Law 25 of 1944 that decides The application of the law of the deceased non-Muslim, if all the heirs agree to apply it, but this law remained inactive. The party stressed that Egypt, which has the oldest government in history and the oldest human civilization, which mankind knew as the mother of the world, can never be shortened to be a city, indicating that this is extreme ignorance of Egypt and its historical status, which requires accountability for those who chose the new name, stressing that Egypt has not and will not. To be a city, dear Egypt was found first, then history came.

Nagy Al-Shihabi, head of the Generation Party and general coordinator of the National Coalition of Egyptian Political Parties and a member of the Presidential Council of the Free Reform Movement, stressed the need to stop this provocative campaign and hold the board of directors of Nasr City accountable, for the following reasons: First, Madinet Nasr Housing and Development Company was established in 1959 and established Nasr City. The Dalai Lama apologizes after a video of him kissing a child on the lips

The 14th Dalai Lama apologized after a video clip spread of him kissing a child on the lips and then asking him to suck his tongue at an event in northern India.

In a statement released Monday, the Dalai Lama's office said it "wishes to apologize to the boy and his family, as well as his many friends around the world, for the hurt his words may have caused," adding that it "sorries" for the incident.
