According to Zeng, he thought through reverse thinking that gambling websites can operate odds in the background, and of course, they can also quietly control the background through Trojans and change the odds.

Next, Zhou Mou, an accomplice who is proficient in computer technology, discussed the feasibility of "fleecing wool" to a gambling website. After many attempts, he finally succeeded. At first, he only bought his own wool, and later he "started his own business" again. Buy computers and recruit a number of employees to open a "branch".

Zhou also developed a plug-in program and set a "formula" based on probability. The plug-in software makes regular bets according to the "formula" and finally makes a profit by betting to win money or return the lottery. In order to monitor the movements of their employees, the two also "developed" remote control software to control all computers in both companies in real time.

Every week, they recharge more than 150 gambling accounts for employees to use and gamble with virtual coins. On average, Zeng and others can make a profit of more than 100,000 yuan per month.

The matter sparked discussion on the Internet.

Some people said, "well done, black eat black, criminals should use this method to teach these gambling websites a lesson!" Some people say that Zeng's behavior is undesirable. "if you find an illegal behavior, you should report to the police that gambling websites are illegal, and it is also illegal to buy wool, and wisdom is used in the wrong place."

We all know that gambling is illegal. Is it a crime for Zeng and others to buy the wool of gambling websites? What crime does it constitute?

Legally speaking, it is an indisputable fact that their participation in gambling constitutes a crime, so the public security organs investigate and deal with them in accordance with the law.

Through practical cases, there are two kinds of punishment opinions for this kind of behavior:

The first opinion is that it constitutes the crime of gambling and the crime of opening a casino.

In this case, Zeng and Zhou subjectively take profit as the purpose, organize a number of people to participate in gambling, and provide them with crime venues, computers and other crime tools to distribute gambling funds and teach criminal methods of recruiting personnel, making a profit of 100000 yuan a month.

This behavior destroys the social atmosphere, hinders the social management order, does harm to the society, and accords with the objective constitutive elements of gambling crime.

Article 303 of the Criminal Law stipulates that whoever gathers people to gamble or takes gambling as his profession for the purpose of making profits shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance, and concurrently be sentenced to a fine.

In addition, in this case, Zeng and Zhou should not only bear legal responsibility for their own participation in gambling, but also bear legal responsibility for providing gambling facilities for their recruited employees.

The second opinion is that this case should be found to be a crime of fraud

Hold this opinion because Zeng and Zhou and others subjectively have the purpose of deceiving the rebate of the website through "gambling" this kind of false gambling. Objectively, they have mastered the "technology" to carry out false gambling and conceal the behavior of deceiving rebates.

In other words, because the implementation of gambling by Zeng and Zhou is only a means to implement fraud, in essence, it is to achieve the purpose of fraud, so it should constitute the crime of fraud.

The third opinion is that it constitutes larceny.

This view holds that Zeng and others took advantage of the loophole to steal property from gambling websites for the purpose of illegal possession, which constitutes a crime of theft, and the amount is particularly huge, which is punishable by fixed-term imprisonment of more than ten years or life imprisonment, and concurrently be sentenced to a fine or confiscation of property.

What do you think?
